What is Qualified Immunity?

It is the legal doctrine that shields police from being personally sued as long as the they did not violate “clearly established” law. In laymans terms, it protects cops from being held accountable after killing Black people. The powers that be claim that the idea is to protect the police from lawsuits and allow for mistakes made in tense and dangerous situations, and insure that they won’t, for instance, lose their house in a civil suit.

But individual cops are rarely sued. In 99.98 percent of the time, it is a city that is sued. In the Breonna Taylor case, the City of Louisville will be paying Ms. Taylor’s family 12 million, not the individual officers.

Another problem in the doctrine is the "clearly established" part. Lower courts often dismissed police brutality lawsuits on grounds that there is no prior court decision in a similar case. For instance, there have been dozens of cases just as bad as the George Floyd case, but they were thrown out of court on the grounds that there was no "clearly established" court precedent forbidding the conduct at issue. But if cases are constantly thrown out, no precedent can ever be established.
